Description
On November 15, 2021, Owner and Tenant entered into a Lease Agreement for the lease of the Factor Property (the “Lease”) pursuant to which Tenant intended to operate a production and distribution facility on the Factor Property. The water demand of the Business exceeds the volumes reflected in the 2021 AGS Water Report and flows of wastewater being discharged to the 157th Ave WRF exceed the volumes reflected in the 2021 AGS Sewer Report. Tenant utilized water from a fire hydrant from August 18, 2023 to August 21, 2023 to deliver water to the Business. This use has since been suspended. To meet that full build-out daily water demand, Tenant is now seeking to install a larger 4-inch water meter for the Factor Property, and to increase the water and wastewater service allocations for the building on the Factor Property.
